Introduction

This Privacy Policy describes the data protection practices that EnterpriseDB Corporation, its subsidiaries, and affiliates (“EDB”, “we”, “us”, “our”) employ when collecting, using, and handling (“processing”) Personal Information of individuals who use our websites, products, support and other services, mobile applications, social media pages, or other services that link to this Privacy Policy; interact with us during in-person meetings at our facilities or at events; and in the context of online or offline sales and marketing activities (collectively, “Offerings”). It also explains the choices you have in relation to these processing activities.

As used in this Policy, “Personal Information” means information that relates to an identified or identifiable individual. It does not include de-identified or aggregate information.

This Privacy Policy does not apply to Personal Information:

  • Our employees provide us in connection with their employment, which is covered by our Global Employee Privacy Policy.
  • An individual makes available to us in connection with the recruitment process, which is addressed separately by our Recruitment Privacy Policy.
  • Processed on behalf of our customers when providing cloud, technical support, and consulting services, which is described in the EDB Data Processing Addendum, End User License Agreement, and related product documentation. Customer end-users should direct any questions about our customers’ privacy practices to our customer who collected their information.

1. Categories of Personal Information

The Personal Information EnterpriseDB collects and processes depends on how you interact with us and includes:

  • name and physical address, email addresses, and telephone numbers
  • demographic attributes
  • photographs and testimonials
  • public information about your work, industry, role and education history, including professional affiliations
  • information you provide on public social media profiles, as well as publicly available information such as social media posts
  • transactional data, including products and services ordered, financial details, billing, and payment methods
  • company data such as the name, size and location of the company you work for and your role as well as publicly available company information and activity associated with company data
  • data from surveys conducted by EDB or by third parties on behalf of EDB
  • call recording and chat transcript data from sales and customer support calls and chat sessions or focus groups
  • unique IDs such as your mobile device identifier or cookie ID on your browser
  • IP address and information that may be derived from IP address, such as geographic location
  • information about a device you use, such as browser, device type, operating system, version, screen resolution, and the preferred language
  • information used to create and administer your online account such as username and password
  • information needed to validate licenses
  • information you share with us through our communication channels including the Support Portal and chat services
  • certain location or geolocation information you provide directly or through automated means, if you choose to enable location-based services from your device
  • behavioral data of the internet-connected computer or device you use when interacting with EDB’s sites, such as advertisements clicked or viewed, sites and content areas, and date and time of activities
  • information we obtain from third-party information brokers and event organizers to enrich our sales & marketing database
  • inferences drawn from any of the information identified above to create a profile about you reflecting your preferences
  • information related to use of the EDB Helpline, including contact details and reported information

Certain online information about you or device information may originate from the use of cookies and similar technologies (for example, pixel tags and device identifiers) on our sites or sites of third parties. For more information on cookies and similar technologies, please see Section 9, Cookies, below.

2. Purposes for Processing Your Personal Information

EnterpriseDB processes your Personal Information for the following purposes:

  • To provide, operate, maintain, and improve our Offerings
  • To enable you to access and use our Offerings
  • To process and complete transactions, and send you related information, including purchase confirmations and invoices; this may include review against government denied/sanctioned parties list where required by law
  • To send transactional messages, including responses to your comments, questions, and requests; provide service and support; and send you technical notices, updates, security alerts, and support and administrative messages
  • To send promotional communications, such as providing you information about products and services, features, surveys, newsletters, offers, promotions, contests, and events (you can always unsubscribe from our marketing emails by clicking here)
  • To monitor and analyze trends, usage, and activities in connection with our Offerings
  • To investigate and prevent fraudulent transactions, unauthorized access to the services (including, the DBaaS Services) and the Website, and other illegal activities
  • To personalize the services (including, the DBaaS Services) and the Website, including by providing features or advertisements that match your interests and preferences
  • To enforce our terms and conditions or protect our business, partners, or users
  • To prepare for and act in relation to enquiries, investigations or proceedings by governmental, administrative, judicial or regulatory authorities, as well as civil litigation
  • In connection with a potential asset or stock acquisition, or the outsourcing or insourcing of services, or meeting any disclosure obligations as required by law

3. Legal Basis for Processing

For personal information collected about you in the EU/EEA, the UK and other relevant jurisdictions, our basis for processing is the following:

  • We rely on our legitimate interest in processing contact and related information about you in order to communicate adequately with you, to respond to your requests, and to tailor our marketing and sales activities to your professional interests.
  • In order to engage in transactions with customers, suppliers and business partners, and to process purchases and downloads of our products and services, we need to process information about you as necessary to enter into or perform a contract.
  • We process personal information for marketing and sales activities (including events) based on your consent where indicated on our sites at the time your personal information was collected, or further to our legitimate interest to keep you updated on developments around our products and services which may be of interest to you.
  • We rely on our legitimate interest to analyze, develop, improve and optimize our Offerings and to maintain the security of our sites, networks and systems.
  • In order to comply with applicable laws and regulations, such as to comply with a subpoena or other legal process, or to process an opt-out or other data subject request.

4. With Whom We May Share Your Personal Information

EnterpriseDB may share your Personal Information with the following third parties:

  • our affiliates globally;
  • third party service providers who help facilitate our Offerings (for example, by providing website development, statistical analyses, data processing, technical support, hosting services, customer relationship management, and payment processing);
  • financial institutions, credit card companies, collection enterprises, consultants, auditors and other professional service firms;
  • affiliated or non-affiliated sponsors and/or promotional partners of certain contests, sweepstakes, and special events. The information collected in conjunction with events (and where required, with your consent) may also be used for the marketing of additional services and events by us and/or our promotional partners and sponsors beyond the contest, sweepstakes, and/or special event;
  • third parties as required to enforce our rights arising from any contracts entered into between you / your company and us;
  • third parties, including, but not limited to, law enforcement agencies, state, local or federal governments, private litigants, and other companies, as may be required to (1) comply with lawful requests such as subpoenas or court orders, (2) comply with applicable international, state, federal, or local law, (3) prevent fraud or other illegal activities from being perpetrated through the Website or in connection with the services, or (4) protect the property, safety, or legal rights of EnterpriseDB, its employees and its users;
  • any third party whom you have consented to receive your Personal Information; and
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

We will not provide your Personal Information to third party advertisers, except as provided in this Privacy Policy, without your permission; however, we may provide information in a form that is not identifiable, such as your age, interests, or the way you use the Website, to any third party for any purpose including customizing and targeting advertising messages.

We may use third-party service providers to deliver artificial intelligence and generative artificial intelligence capabilities to analyze data, determine trends, make predictions and create AI-generated responses or other content for the purposes and pursuant to the legal bases described above in Section 3, Legal Basis for Processing, above.

5. International Transfers of Personal Information

As EnterpriseDB operates globally, we may transfer Personal Data about you for purposes specified above to third parties outside your location or jurisdiction, including to countries not considered in your jurisdiction to provide an adequate level of data protection. Personal Data will only be transferred from your location to a recipient in a country which is not considered to provide an adequate level of data protection when the transfer is made in compliance with applicable data protection laws. We will take steps to ensure the recipient of your Personal Data implements an adequate level of data protection as required by applicable data protection laws.

Transfer of Personal Data outside the EEA/UK
We may transfer Personal Data about individuals who reside in the EEA or UK to locations outside of your location in the EEA/UK, including in the U.S., which are not considered by the European Commission and/or the UK Government (as applicable) to provide an adequate level of data protection.

EnterpriseDB has entered into standard contractual clauses (“SCCs”) for transfers of Personal Data from EnterpriseDB in the EEA/UK to its affiliates outside the EEA/UK. EDB entities in the EEA/UK, and EnterpriseDB Importers outside of the EEA/UK, may transfer Personal Information to third party recipients located outside the EEA/UK for the purposes set out in this Policy. We only make such onward transfers to recipients ensuring appropriate safeguards pursuant to data protection requirements or where otherwise permitted by the SCCs, which may include entry into further SCCs.

Where EDB transfers Personal Information to service providers outside of the EEA/UK, we will enter into SCCs with the recipient or seek assurances from the recipient that they have Binding Corporate Rules in place or rely on a derogation such as where necessary for the establishment, exercise or defense of legal claims.

6. Collection of Information by Third-Party Sites and Sponsors

The following third parties may collect information, including Personal Information, through the Website (where required, with your consent):

  • Third party advertisers may collect information about your mobile phone, computer or mobile device relating to the way you interact with the Website, or which third party advertisers you visit
  • Third parties may collect other information that you voluntarily post or publish through the Website
  • Web-crawlers such as Google may collect information through the Website
  • The Website may contain links or references to other websites, including third party advertisers and other unaffiliated websites

7. How We Secure and Store Personal Information

We have put in place reasonable and appropriate physical, electronic, and managerial procedures to help safeguard information we collect through the Website. However, no company, including EnterpriseDB, can fully eliminate security risks associated with Personal Information. To help protect yourself, please use a strong password, do not use the same passwords to access your EnterpriseDB accounts that you use with other accounts or services, and protect your usernames and passwords to help prevent others from accessing your accounts and services.

8. Retention

We store Personal Information for as long as necessary to fulfil the purposes described above. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of the Personal Information, the purposes for which we process the Personal Information, and whether we can achieve those purposes through other means. We also consider applicable legal requirements and the extent to which it is necessary to process the Personal Information. In exceptional cases (e.g., in pending litigation matters or where the law requires) your Personal Information may need to be kept for longer periods of time.

9. Use of Cookies

You can choose whether our Website may use cookies or related technologies such as web beacons, pixel tags, and Flash objects (“Cookies”) as described below and in our Cookie Preferences link in the Website footer or cookie banner.

What are cookies?
A Cookie is a small piece of data (text file) that a website or app – when visited by a user – or when you interact with an email, asks your browser to store on your device in order to remember information about you, such as whether or not you have consented to our use of cookies. Those cookies are set by us and are called first party cookies.

We also use third party cookies – these are cookies from a domain different than the domain of the website you are visiting or a domain we are not operating – for example for personalization and advertising purposes.

We may also use web beacons and pixel tags which are small pieces of code placed on a webpage to monitor the behavior and collected data about website visitors (for example, to count the number of visitors to a webpage or deliver a cookie).

How we use Cookies
Our websites use two types of cookies: persistent and session cookies. Persistent cookies are cookies that remain on your device for a certain period of time (as indicated in the table below) or until you manually delete them or object to them. We use non-essential (non-strictly necessary) cookies to (i) deliver targeted advertising on the basis of your browsing behavior; (ii) understand your interactions with our website to help us improve it; and (iii) personalize our Website content based on your browsing behavior. Cookies may be first party or third party, meaning they are operated by us (first party) or by another party (third-party). Please note that interactions with the third-party cookies on our website are governed by the privacy and cookie policies of the third party as set out in the Cookie Preferences link. Global Privacy Control (GPC)
EDB recognizes Global Privacy Control (“GPC”) signals where legally required. GPC is a browser setting that a user can set in order to send a signal to websites visited regarding the user’s cookie preferences. If your browser or browser extension has GPC enabled, we will recognize that signal and opt you out of non-essential cookies. 10. Our Policy Towards Children

As a company focused on serving the needs of businesses, EnterpriseDB does not knowingly collect, solicit or sell Personal Information from minors. If we learn that we have obtained Personal Information from a minor, we will delete that information as soon as practicable. 11. Your Rights in Relation to Your Personal Information

Depending upon your jurisdiction, you may have the following rights with regard to Personal Information which we process about you, which may be subject to limitations and/or restrictions:

  • Right to request access to the Personal Information we process about you
  • Right to request us to rectify any Personal Information that might be incorrect, as well as the right to request us to restrict the processing of your Personal Information
  • Right to request to receive a copy of your Personal Information that you provided to us, in a structured, commonly used and machine-readable format
  • Right to request that we erase your Personal Information
  • Right to object to the processing of your Personal Information and to withdraw consent to the processing of your Personal Information at any time
  • Right to lodge a complaint with the competent data protection supervisory authority or other appropriate authority

12. Disclosures and Rights Applicable to California Residents

The California Consumer Privacy Act (“CCPA”) provides additional rights and protections to California residents related to data privacy. In accordance with the CCPA, California residents may request that EDB:

  1. Disclose the following information covering the twelve (12) months preceding your request:
    • a. the categories and specific pieces of Personal Information we collected about you;
    • b. the categories of Personal Information we sold or shared;
    • c. the categories of sources from which we collected such Personal Information;
    • d. the business or commercial purpose for collecting or selling Personal Information about you; and
    • e. the categories of third parties to whom we sold or otherwise disclosed Personal Information about you.
  2. Correct inaccurate information we may have about you, unless retained solely for legal and compliance purposes and as otherwise set out in the CCPA.
  3. Delete Personal Information we collected from you, unless retained solely for legal and compliance purposes and as otherwise as set out in the CCPA.

The categories of Personal Information we collect about you are included in this Policy in Section 1, Categories of Personal Information, and the business purposes are set out in Section 2, Purposes for Processing Your Personal Information. EDB’s retention periods are set out in Section 8, Retention. For purposes of the CCPA only, Personal Information does not include publicly available information that is lawfully made available from government records that you have otherwise made available to the public and any other information specifically excluded from the CCPA’s scope.

In addition, we will not discriminate against you, including any retaliation against you, for exercising your rights under the CCPA. If you submit a request, please be specific as to what right you are asserting (e.g., access, correction, etc.) and which specific pieces of Personal Information are in scope of your request. In some cases, in order to comply with applicable law or a legal obligation, EDB may deny your request or may seek more information from you in order to respond to your request. We do not sell or share Personal Information or Sensitive Personal Information as the terms ‘sell’ and ‘share’ as defined in the CCPA.

California Do Not Track
Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, our Website does not respond to browsers’ do not track signals.

Shine the Light
California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about certain categories of personal data a business has disclosed to third parties for direct marketing purposes in the preceding calendar year. To make such a request, contact us by one of the methods below.
